1. Information We Collect
When you create an account we collect your email address and a hashed password. If you subscribe to a paid plan, Stripe processes your payment information — we never see or store your full card number, bank account details, or other financial credentials. We store your Stripe customer ID, subscription status, and billing dates.
2. API Keys (Bring Your Own Key)
Capable.ai uses a Bring Your Own Key model. Your AI provider API key is transmitted directly to your server during deployment and exists only in your browser session and on your own infrastructure. We never store, log, or route your API key through our systems.
3. Your Server & Data
Your AI agent runs on a virtual private server (VPS) that you own and control. All conversation data, memory files, knowledge documents, and activity logs reside exclusively on your server. We do not have access to your server or its data after deployment. You are solely responsible for securing your server, backups, and any data stored on it.
4. Cloud Hosting Integration
When you deploy an agent we may use temporary OAuth tokens to provision a server on your behalf through your chosen cloud provider. These tokens are used during deployment only and are not stored long-term. We may earn affiliate revenue from cloud hosting referrals.
5. Affiliate Links
Our site may include links to third-party services. Some of these are affiliate links and we may earn a commission at no extra cost to you if you sign up through them.
6. Cookies
We use a session cookie to keep you logged in. We do not use tracking cookies or third-party analytics.
7. No Warranty on Data Security
While we employ commercially reasonable measures to protect information transmitted through our platform, no method of electronic storage or transmission is 100 % secure. We disclaim all warranties, express or implied, regarding the security of your data. You acknowledge that you provide information at your own risk.
8. Limitation of Liability
To the fullest extent permitted by applicable law, iGOTHAM Holdings, its officers, directors, employees, and affiliates (collectively, “Capable.ai”) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of the service, your server, your AI agent, or any third-party services. In no event shall our aggregate liability exceed the greater of fifty US dollars (US $50) or the total fees you paid us in the twelve (12) months preceding the claim.
9. Changes to This Policy
We may update this policy from time to time. We will notify you of material changes by email or by posting a notice on our site. Continued use of the service after changes constitutes acceptance of the updated policy.
